These terms apply to your use of ELVT – Hypertrophy by Design (the “App”) and the website elvthypertrophy.com. The provider is Timo Weber, Oneaxis Engineering, Hauptstraße 233f, 28816 Stuhr, Germany (see the Imprint). By downloading or using the App you accept these terms. If you do not agree, do not use the App. We publish our videos on YouTube with an internal tool that uses YouTube API Services; anyone using that tool agrees to be bound by the YouTube Terms of Service.

ELVT is free to download and use and is supported by ads. ELVT Pro is an optional subscription that removes ads and unlocks additional features. The App shows which features belong to Pro; free users can see that a Pro feature exists and can open the offer from there.

ELVT Pro is an auto-renewing subscription (monthly or annual) offered through the Apple App Store or Google Play, which act as the seller.

• Price and period: shown in the store before you subscribe.
• Payment: charged to your Apple ID or Google Play account when you confirm the purchase.
• Renewal: the subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Free trial: if offered, an unused part of the free trial is forfeited when you purchase a subscription.
• Managing and cancelling: in your App Store or Google Play account settings. Refunds and billing questions are handled by Apple or Google under their policies. Your statutory rights remain unaffected.

We grant you a personal, non-exclusive, non-transferable and revocable licence to use the App on your own devices for your own non-commercial training. You may not copy, modify, resell or reverse engineer the App except where the law allows it, circumvent the paywall, or interfere with the App’s servers and services. On iOS, Apple’s Standard Licensed Application End User License Agreement also applies. On Android, the Google Play Terms of Service also apply. Where these terms conflict with Apple’s agreement, Apple’s agreement prevails to the extent Apple requires.

ELVT is a training log and planning tool for informational and educational purposes. It does not provide medical advice, diagnosis or treatment. Talk to a doctor before you begin or change a training programme, especially if you have a health condition or an injury or are pregnant. Stop exercising and get medical help if you feel pain, dizziness or unwell. You train at your own risk and are responsible for choosing loads, technique and rest that are safe for you. Volume ranges, targets and recommendations are general guidance based on common hypertrophy research, not an individual prescription.

The AI Hypertrophy Coach and the AI Microcycle Blueprint Builder produce answers with generative AI. You are interacting with an AI system, not a human coach. Answers can be incomplete, outdated or wrong, and they are not medical advice, so check anything important and use your own judgement. Use is limited by a daily quota that differs between Free and Pro, and the features can be unavailable offline or temporarily. Do not enter personal or health information you do not want processed as described in the Privacy Policy.

Your training data belongs to you and is stored on your device. You are responsible for keeping backups. The optional cloud backup is a convenience, and we cannot guarantee that every backup can be restored. How data is handled is described in the Privacy Policy.

We aim to keep the App and the website available but do not promise uninterrupted operation. We may update, change or discontinue features. For paid subscriptions, the rules of the respective store apply.

The App, its design, texts, exercise descriptions, articles, illustrations and code are protected by copyright and belong to us or our licensors. Your own training data remains yours.

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and where we have given a guarantee. For slight negligence we are liable only for the breach of an essential contractual obligation, meaning one whose fulfilment makes proper use of the App possible and on which you may regularly rely, and then only for the foreseeable damage typical for this kind of contract. Any other liability is excluded. Mandatory consumer rights are not affected.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country where you live remain unaffected. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
